Alla fine Gabriele Ansaloni, in arte Red Ronnie, è stato assolto dal tribunale di Bologna dall’accusa di aver diffamato il virologo Roberto Burioni. Il conduttore, difeso dall’avvocato Guido Magnisi, era imputato per alcune frasi pubblicate su Facebook dopo un dibattito con il professore ordinario di Microbiologia e Virologia del San Raffaele, nella trasmissione “Virus”: il 15 maggio 2016 scrisse un testo dove lo accusava di «ricerca di protagonismo e di essere legato a interessi economici».

Red Ronnie inoltre riportò la mail di una persona che, riferendosi al professore, diceva tra l’altro: «In questo suo ruolo di moralizzatore, nasconde un lapalissiano conflitto di interessi, ossia l’impegno, in campo vaccinale, di tanti suoi brevetti». Era un periodo in cui si discuteva delle campagne anti-vaccini e Burioni le contestava. Il processo è nato da una denuncia del virologo, annunciata già nel programma tv. Il giudice monocratico Stefano Levoni ha assolto Red Ronnie con la formula perché il fatto non costituisce reato. Le motivazioni saranno note entro 90 giorni.

«Sin da ora, al di là della notorietà dei protagonisti, è bene chiarire come il punto nodale della sentenza è facile da prevedere: sarà il diritto-dovere di una stampa libera di informare il cittadino nel modo più completo e possibile, soprattutto se si fa riferimento ad argomenti così decisivi come quelli attuali». È il commento dell’avvocato Guido Magnisi, difensore di Red Ronnie.

«Questo principio – prosegue il difensore – affermato anche di recente dalla Cassazione, dà finalmente un senso pieno alla professione del giornalista-pubblicista. Fugare i dubbi, regalare al lettore più chiavi di interpretazione cosciente e consapevole della realtà che così da vicino lo tocca. Tanto più in tempi come questi, dove addirittura si è sostenuto che la scienza, e in genere la conoscenza “non debbono essere democratiche”, ma patrimonio esclusivo di un’elite oligarchica talora autoproclamatasi tale. A suo tempo, si parlò di “congiura dei somari”. Ebbene, forse il più grande sociologo del secolo scorso (Niklas Luhmann) certamente non congiurato né somaro, affermò che l’autoreferenzialità è nemica della comunicazione. Oggi si sente il bisogno di scienziati che coniughino umiltà e capacità di farsi comprendere». In definitiva, «per il giudice di Bologna, i giornalisti hanno un ruolo fondamentale di veicolo delle opinioni, anche discordanti».
