Cartelle esattoriali sospese a causa del coronavirus. Le ultime notizie di attualità legate al Covid-19 dall’Italia e dal mondo gli ultimi aggiornamenti sul fisco, le tasse, e le decisioni del Governo.
La nuova ondata di contagi che sta interessando il Paese, porta con sé una serie di pesanti conseguenze economiche per famiglie ed imprese.
Il Governo è al lavoro per limitare almeno parzialmente i danni che le difficoltà finanziarie necessariamente comportano. Il D.L. 129/2020 pubblicato in Gazzetta Ufficiale il 20 ottobre, va proprio in questa direzione.
Intende, in particolare, consentire un po’ di respiro a chi si trova con un debito pregresso e teme di non poterlo onorare. Insomma, buone notizie per chi ha cartelle esattoriali non pagate.
Soltanto, però, per i casi previsti dal Governo.
Vediamo quindi cosa prevede il nuovo Decreto e come possiamo beneficiarne.
Cartelle esattoriali sospese, chi può non pagare
Premettiamo che le buone notizie per chi ha cartelle esattoriali non pagate sono solo parziali. Il Decreto, infatti, prevede un rinvio delle notifiche e dei relativi pagamenti solo per alcune cartelle.
Ovvero per quanto trasmesso all’Agenzia delle Entrate nel periodo compreso tra l’8 marzo e il 31 dicembre di quest’anno.
In altre parole, otterranno un rinvio i contribuenti che hanno cartelle relative al periodo di restrizioni imposte dall’Esecutivo.
Le condizioni del Decreto
Il nuovo Decreto interessa le cartelle comprese nel periodo indicato solo se non già oggetto dei benefici previsti dal Decreto Rilancio. I contribuenti potranno quindi rinviare i relativi pagamenti fino al 31 dicembre 2022.
Per le cartelle relative ai controlli formali sulle dichiarazioni dei redditi 2018, il rinvio previsto slitta alla fine del 2023. In altre parole, molti italiani potranno affrontare i prossimi mesi con una maggior serenità.
I benefici potranno interessare l’intero tessuto economico, con la speranza che questo arco temporale basti a far riprendere l’economia nazionale.
Le precisazioni
Le buone notizie per chi ha cartelle esattoriali non pagate potrebbero però finire proprio qui.
Il D.Lgs 159/2015 prevede infatti che durante i periodi di sospensione siano prorogati proporzionalmente anche i termini di decadenza e prescrizione.
Di conseguenza, eventuali cartelle in scadenza a fine anno rimarrebbero valide fino alla fine del 2022. Inoltre, alcune cartelle non beneficeranno di alcun rinvio.
In particolare, quelle relative ad IMU, TARI, bollo auto e contributi previdenziali.
In conclusione, il D.L. 129/2020 aiuterà certamente molti contribuenti nell’immediato ma non prevede alcuna cancellazione di quanto dovuto.
Posticipando quindi il rischio di un eccessivo appesantimento per le casse di famiglie ed imprese. Un problema che graverà particolarmente sui soggetti meno solidi finanziariamente.
