“Il Governo non può scaricare la responsabilità soltanto sui sindaci”.
Queste le parole con cui il presidente dell’ANCI, e sindaco di Bari, Antonio Decaro, ha iniziato la sua contestazione alla decisione di Conte, relativa al nuovo DPCM, riguardante i sindaci.
Questi ultimi, secondo quanto previsto, potranno chiudere le piazze e le vie della città (e della movida) dopo le ore 21.
L’Associazione Nazionale Comuni Italiani, appunto, critica tale scelta ritenendola da “scarica barile”.
Decaro, quindi, continua: “E’ sbagliato anche perchè non è previsto che la polizia locale si occupi di Covid”.
DPCM sindaci, le reazioni
A rincarare la dose ci pensa il sindaco di Bergamo, Giorgio Gori: “Nel testo definitivo è stato tolto il riferimento esplicito ai Sindaci che c’era nella bozza, citato da Conte in conferenza stampa. Ma non si dice a chi competerebbero quelle misure: se ai Sindaci, ai Prefetti, ai Presidenti di Regione. Né con quali mezzi si possano attuare”.
“Per chiudere una piazza con cinque vie d’accesso – aggiunge Gori – servono almeno 10 agenti. Chi li ha? Poi però, dice il DPCM, bisogna consentire l’accesso agli esercizi commerciali e alle abitazioni. Come si controlla? E se la gente si sposta e si assembra nella via accanto? Inapplicabile“.
Il ministro per gli Affari regionali Boccia, invece, difende l’operato del governo e tenta una mediazione.
Il presidente del Veneto Zaia chiede più autonomia sulle misure per le Regioni.
Le parole del Viminale
Nella polemica interviene il Viminale. “Col nuovo Dpcm lo Stato non abbandona i Comuni né li investe di responsabilità improprie: i primi cittadini, che sono autorità sanitarie locali, saranno ovviamente supportati in tutto dai Prefetti, negli appositi Comitati provinciali di ordine pubblico.
Ed è proprio con i Prefetti e nei Comitati Provinciali che si potranno valutare casi particolarmente delicati in cui risultasse necessario, opportuno e possibile chiudere al pubblico strade o piazze”.
“Laddove si rivelassero condizioni di urgenza, nell’arco di 24 ore si può far anche l’ordinanza di chiusura, ma è chiaro che non devono essere tralasciati una serie di passaggi, non ultimo quello che, quando un provvedimento riguarda un’esercizio, va notificato”. Lo ha detto all’ANSA il Sottosegretario all’Interno con delega agli Enti Locali, Achille Variati.
“Essendo una motivazione di natura sanitaria – ha aggiunto Variati – il Prefetto non ha una capacità di emettere l’ordinanza ma di attuazione di quest’ultima.
Il sindaco fa l’ordinanza e lo strumento è il Comtato di ordine e sicurezza pubblica, che supporterà, motiverà e accompagnerà il sindaco sull’opportunità di emettere il provvedimento da lui firmato”.
Per emettere ordinanze di chiusura come quelle previste nel DPCM “bisognerà sentire anche l’Asl, che potrà essere invitata dal Prefetto al Comitato per l’ordine pubblico, per portare tecnicamente il pensiero della sanità locale.
Sicuramente saranno valutate anche le relazioni delle forze dell’ordine stilate a seguito delle loro verifiche in quei luoghi dove eventualmente dovessero verificarsi assembramenti”, ha detto il Sottosegretario.
