Alassio – “Ok a migranti solo se non malati”: l’ordinanza del sindaco è razzista

Alassio – La sentenza che stabilisce che l’ordinanza sui migranti emessa ad Alassio è razzista e discriminatoria: i dettagli. Le ultime notizie di politica dall’Italia e dal mondo tutte le ultime news di attualità aggiornate.

Lo ha stabilito il Tribunale di Savona. L’ordinanza risalente al 2015 e firmata dall’ex sindaco di Alassio, con la quale si permetteva l’insediamento nel Comune a cittadini africani o sudamericani solo se presentavano un certificato che testimoniava l’assenza di malattie trasmissibili, è razzista e discriminatoria. Un provvedimento che non aveva nulla a vedere con esigenze sanitarie specifiche, ma che era basata solo sulla razza e sul Paese di provenienza degli stranieri. Perché, inutile dirlo, a cittadini di altre nazionalità nessuna prova del genere veniva richiesta.

Cosa stabiliva l’ordinanza

La vicenda risale a sei anni fa. Enzo Canepa, esponente di Cambiamo e allora primo cittadino di Alassio, aveva firmato un’ordinanza con la quale impedita di stabilirsi nella cittadina ligure in assenza di un “regolare certificato sanitario attestante la negatività da malattie infettive e trasmissibili”. Dal tribunale di Savona era però arrivata la notifica di un decreto di condanna, chiesto dal sostituto procuratore, con una sanzione di 3.750 euro. Il motivo? Discriminazione razziale.

La sentenza della Cassazione

A dicembre la sentenza definitiva della Cassazione, di cui oggi sono arrivate le motivazioni, riportate dal Sole 24 Ore. L’ex sindaco si era difeso affermando che l’ordinanza era stata una conseguenza della “dovuta preoccupazione dovuta ai molteplici casi di scabbia documentati nel ponente ligure ed alcuni focolai di polmonite”. In altre parole, sarebbe stata una questione di salute pubblica. Non è andata così, chiariscono i giudici di Savona, che condannano l’ex sindaco.

Le motivazioni: “Provvedimento discriminatorio e razzista”

La normativa di riferimento è la legge 654/1975, nell’articolo 3, contro la diffusione dell’odio razziale per cui va condannato chi incita alla discriminazione in qualsiasi modalità. Nessun pericolo per la salute pubblica, ma discriminazione di precisi individui, in particolare africani e sudamericani. “Si è realizzata una forma di discriminazione, attraverso un atto amministrativo, su pura base razziale, senza spiegare né indicare la ragione per la quale i soli soggetti aventi quell’etnia dovessero essere “pericolosi” per la salute pubblica e si è richiesta per il superamento una prova irrealizzabile per la ragione indicata, non potendo la Asl rilasciare certificati aventi quel contenuto”, spiega la Corte Suprema. Infatti, molte delle persone colpite dall’ordinanze erano stranieri senza fissa dimora che non potevano usufruire del Servizio sanitario nazionale che avrebbe dovuto rilasciare il certificato in questione.
