Si rifiuta di sottoporsi al vaccino antinfluenzale, obbligatorio per gli operatori sanitari sulla base di un decreto regionale, e il giudice le dà ragione. Un’infermiera del Policlinico di Messina ha vinto la causa davanti al tribunale del lavoro. Un doppio smacco. Per l’assessorato alla Salute, costretto a risarcire 900 euro di spese legali all’infermiera, e per la scienza, che invece raccomanda fortemente la vaccinazione soprattutto per chi lavora in corsia.

Le vaccinazioni antinfluenzali, quest’anno più che mai, sono fortemente raccomandate da tutti gli organi sanitari, compresi il ministero e l’Istituto superiore di sanità. Ma secondo il giudice l’obbligo non può essere introdotto dalle Regioni, ma solo con una legge dello Stato. “A prescindere dalla valutazione della ragionevolezza degli atti contestati da parte ricorrente – si legge nell’ordinanza del tribunale – l’introduzione dell’obbligo del vaccino non appare rientrare nella competenza regionale”.
Con questa motivazione il giudice del lavoro ha accolto il ricorso di un’iscritta al Nursind, difesa dal consulente legale nazionale del sindacato. Sospendendo l’efficacia del decreto e della nota in cui l’azienda la esortava a vaccinarsi entro il 20 dicembre, pena la sospensione temporanea dal servizio per tutta la campagna vaccinale. Il decreto del 5 ottobre, infatti, esime dall’obbligo solo chi ha documentati problemi di salute che rendono rischiosa la vaccinazione.
Un decreto che nasce da diverse esigenze: il tentativo di salvaguardare gli operatori sanitari dal rischio di farsi vettori di diffusione di virus in corsia, la possibilità di escludere in caso di comparsa di sintomi influenzali virus diversi dal Covid, la riduzione del rischio di contrarre forme più gravi di infezione. Secondo gli scienziati, infatti, le forme influenzali comuni possono predisporre maggiormente l’apparato respiratorio a contrarre il coronavirus in forma più grave.
