Come primo punto si sottolinea che “Open Arms ha agito di sua iniziativa. Al di fuori delle regole sul soccorso in mare, nel tentativo di far entrare in Italia migranti irregolari. Per tale ragione, sin da subito l’Italia ha vietato l’ingresso nelle proprie acque territoriali”.
Secondo: “Non spettava all’Italia indicare un ‘porto sicuro’ ai migranti che erano saliti a bordo della nave Open Arms dopo essere stati recuperati in acque libiche e maltesi da una nave battente bandiera spagnola”.
Terzo: “L’Italia infatti non era né Stato di primo contatto né Stato coordinatore, non avendo mai assunto il coordinamento delle operazioni di soccorso“.
Quarto e quinto punto: “L’Italia ad ogni modo non si è sottratta dal fornire sempre assistenza ai migranti” e inoltre “i minori giunti in prossimità delle acque italiane sono stati fatti sbarcare“.
Il sesto punto ricorda come “il comandante della Nave Open Arms ha sempre avuto numerose alternative. Ad esempio, il 1 agosto, dopo il primo trasbordo, era a meno di tre giorni di navigazione dalla Spagna. Perché non si è diretto lì sin da subito e ha insistito per voler sbarcare in Italia?“, è la domanda che si pone dalla difesa dell’ex ministro.
Settimo. “La gestione di tale episodio di immigrazione irregolare costituiva attuazione della linea di Governo. Condivisa dalla Presidenza del Consiglio dei Ministri e dai Ministri competenti, secondo quanto concordato nel ‘Contratto per il governo del cambiamento’ sottoscritto dalle forze di maggioranza dell’epoca”.
“Tale linea – si ricorda – prevede il raggiungimento di un accordo di redistribuzione dei migranti tra gli Stati membri dell’Unione europea come fase prodromica al successivo sbarco”.
Ultimo aspetto ricordato, l’ottavo punto. “All’epoca dei fatti il comandante Marco Reig Creus”, fa notare la difesa di Salvini, sarebbe stato “già indagato per violenza privata e favoreggiamento dell’immigrazione clandestina. Due dei migranti che erano a bordo sono attualmente in carcere”.
