La Svizzera mette al bando il burqa e comparire in pubblico con il volto coperto sarà un comportamento presto sanzionato dalla legge. Lo ha stabilito un referendum tenutosi nella Confederazione Elvetica e che, con un risultato netto anche se non nettissimo, proibisce l’uso del velo islamico integrale. La «sentenza» popolare arriva per un gioco del destino alla vigilia dell’8 marzo, festa della donna. La proposta di legge, promossa dai partiti della destra nazionalista è passata con il 51,2% dei consensi e in 20 dei 26 Cantoni: nelle consultazioni popolari è sempre necessaria questa doppia affermazione perché il risultato risulti valido. Viene in questo modo bocciata la linea espressa dal governo e dal Parlamento che avevano invitato a respingere l’iniziativa. Con il voto odierno Berna si allinea ad altri Stati europei (ad esempio Francia e Austria) che già proibiscono il burqa in pubblico.

Quando lo spoglio delle schede è vicino a essere completato , il risultato appare deciso: il fronte dei contrari all’uso del burqa (ma anche del niqab, cioè l’indumento che lascia scoperti soltanto gli occhi) scaturisce da un voto abbastanza uniforme che ha avuto la sua puta massina in Canton Ticino (60,5%) dove una legge regionale già vieta alle donne musulmane di indossare il velo integrale in pubblico, e la quota più bassa a Basilea (40,6).
«Simbolo di sottomissione»
Il titolo della consultazione popolare non faceva esplicito riferimento ai motivi religiosi (la definizione esatta era infatti «contro la dissimulazione del viso»). Ma nel corso della campagna elettorale i promotori non avevano fatto mistero che questa fosse la vera molla dell’iniziativa. A loro giudizio il burqa è un simbolo della sottomissione della donna incompatibile con i valori costituzionali, la convivenza civile, la certezza del diritto e la parità dei sessi. Da qui la formulazione della proposta che nel suon testo originale prevede anche alcune eccezioni: il volto può rimanere nascosti per motivazioni di sicurezza, sanitarie o in occasione del Carnevale.
Le ragioni del no
Come detto, il governo e il parlamento si erano detti contrari a questa legge: dato lo scarso numero di donne che aderisce a questa pratica, la consideravano eccessiva. Di conseguenza l’indicazione era quella di delegare ai singoli cantoni eventuali divieti . Un’imposizione a livello nazionale, secondo le istituzioni federali, avrebbe danneggiato il turismo e aumentato l’isolamento delle donne costrette a comparire in pubblico a volto coperto.
