Sul vetro del portone di un anonimo condominio appare un cartello: «Attenzione, ci sono positivi nel condominio, massima cautela». A denunciare l’episodio sui social network è Nadia Andrisolo, vice presidente dell’associazione Multisolidarietà, che avverte: «Cartelli di questo tipo non sono legali».
Il suo post che racconta quanto avvenuto nell’hinterland milanese ai danni di una famiglia positiva al Coronavirus e in quarantena domiciliare, ha scatenato un’accesa discussione tra favorevoli e contrari. «Siamo al periodo della peste? Aspetto la striscia rossa di vernice alla porta», aggiunge Nadia Andrisolo, ricordando i doveri di ogni amministratore di condominio legati alla privacy. «La persona positiva del Covid-19 non è tenuta a comunicarlo all’amministratore, né ai singoli condomini; di conseguenza, anche l’amministratore, in caso di conoscenza “informale” di un caso di Covid-19, non è tenuto a darne diffusione del condomino contagiato agli altri condomini. In caso contrario, l’amministratore si esporrebbe ad eventuali conseguenze: azioni risarcitorie da parte della persona positiva al Covid-19 e una sanzione da parte del Garante per trattamento illecito dei dati personali». Per questi motivi, la famiglia coinvolta dalla vicenda avrebbe deciso di presentare una denuncia contro ignoti.
Positivi condominio, il cartello e le diverse opinioni
Ma non tutti sono d’accordo. Per alcuni si tratta di una precauzione innocua: «Mettere un cartello fuori dove viene indicato che ci sono stati casi Covid nel palazzo, non rende untori quelli che purtroppo sono stati positivi — scrive ad esempio una persona — ma dà la possibilità a chi entra in quel palazzo di ricordarsi di proteggersi, a maggior ragione se vi sono stati positivi a prendere l’ascensore o sui corrimano delle scale ecc ecc. Non la vedo una cosa brutta».
La risposta è amara: «È un cartello scritto da chi pensa che il Covid sia un’ onta, qualcosa di cui vergognarsi — conclude Nadia Andrisolo —. Una denuncia ai danni dei vicini colpevoli di essere positivi, chiusi in quarantena nella loro casa, che solo per il fatto di esistere, si pensa possano nuocere al prossimo».
