Autocertificazione – Finito a processo con l’accusa di falso per aver mentito nel dichiarare nell’autocertificazione che stava tornando a casa dal lavoro, durante un controllo a Milano nel marzo dello scorso anno in pieno lockdown da emergenza Covid, un 24enne è stato assolto.
E ciò perché “un simile obbligo di riferire la verità non è previsto da alcuna norma di legge” e, anche se ci fosse, sarebbe “in palese contrasto con il diritto di difesa del singolo”, previsto dalla Costituzione.
Lo ha deciso, accogliendo la richiesta della Procura di Milano di assoluzione “perché il fatto non sussiste“, il gup Alessandra Del Corvo con rito abbreviato.
