Chi ha emesso norme illegittime, chi ha calpestato la Costituzione, chi non ha saputo gestire questo delicato momento storico causando una crisi economica e sociale senza precedenti, chi ha lucrato sul popolo italiano e portato allo stremo il nostro Paese è chiamato a rispondere delle proprie responsabilità.
Un pool di Avvocati ha messo a punto un atto di citazione per chiamare in causa civile, il #Governo, il Presidente del Consiglio, il Ministro della Salute e il Ministro degli interni, i membri del Comitato Tecnico Scientifico, il capo dipartimento della Protezione Civile ed il Commissario per l’emergenza affinché venga riconosciuto ai cittadini il risarcimento dei danni subiti a causa del lockdown: una vera e propria carcerazione illogica e illegittima.
Questa iniziativa, promossa dal Comitato per il risarcimento del popolo italiano dei danni subiti dall’illegittimo lockdown, in collaborazione con associazioni e con vari professionisti, mira a contrastare il continuo, ingiusto e indisturbato gioco al massacro cui il Governo, senza alcuno scrupolo, sta ormai perpetrando da mesi nei confronti delle imprese, partite #IVA e di tutti i cittadini italiani.
La causa pilota verrà radicata davanti al tribunale civile di Roma. E a seguire tutte le Associazione o legali coscienti e consapevoli delle libertà costituzionali violate potranno agire ad adiuvandum.
La quantificazione del danno che verrà richiesto per ogni singolo cittadino, in base alle norme sull’ingiusta detenzione non sarà inferiore ai diecimila euro procapite mentre per le partite Iva il danno verrà calcolato sulla base della diminuzione di fatturato che l’azienda ha subito a causa del lockdown, non solo per il periodo di chiusura, ma anche e soprattutto per tutte le conseguenze subite a causa dei promessi e mancati aiuti previsti dai vari decreti cd. Rilancio, Salva Italia e quant’altro.
Danno emergente e lucro cessante sono i parametri di valutazione e quantificazione del danno oltre ai danni non patrimoniali subiti dall’imprenditore/partita IVA e dai suoi familiari a causa della chiusura nelle proprie mura di casa, ai disagi, agli abusi ed alle ingiustizie subite in questi mesi.
L’aspetto economico non è il solo rilevante nella vicenda: con questa iniziativa, infatti, si vuole dare un chiaro segnale a tutti gli italiani ed al mondo politico di un popolo che non sta a guardare impotente, mentre cercano di distruggere il nostro tessuto economico e sociale.
Quest’azione è promossa dal “Comitato per il risarcimento del popolo italiano dei danni subiti dall’illegittimo lockdown” con il sostegno di numerose associazioni, studi legali, organizzazioni e liberi cittadini”.
